Frederick Hedberg
earned his B.S. in Civil Engineering from the University of Connecticut
in 1988, his M.S. in Mechanical Engineering from Rensselaer Polytechnic
Institute in 1991 and his J.D. from Quinnipiac University School
of Law in 1998 where he was honored with a Distinguished Academic
Achievement Award.
Prior to practicing
law, Mr. Hedberg was an engineer for 11 years in both the private
and public sectors. He is a registered Professional Engineer in
Civil and Structural Engineering. Upon receiving his undergraduate
degree, Mr. Hedberg was employed by Electric Boat, a division of
General Dynamics, where he analyzed and designed internal structures
and foundations and resolved numerous construction issues on various
classes of submarines. He was recognized for designing and implementing
test procedures for tank covers on fast attack submarines under
different shock and stress load conditions. As a structural engineer
for CNF Constructors, a division of Kenetech Corporation, Mr. Hedberg
was responsible for the civil and structural engineering design
and construction of wood-fired power plants, wind power plants and
cogeneration facilities. While attending law school evenings, Mr.
Hedberg was employed by the Connecticut Department of Transportation,
where he managed the design, administration and construction of
transportation projects.
Mr. Hedberg
represents general contractors, major subcontractors, owners, sureties
and design professionals in the construction of both public and
private projects, such as continuing care retirement facilities,
schools, municipal buildings and recreational facilities. Matters
handled involve the negotiation, settlement and litigation of claims
involving mechanics liens, payment and performance bonds,
termination and delay issues and design defects.
His memberships
include the National Society of Professional Engineers, and the
New Haven County, Connecticut (Construction Law Section) and American
(Litigation Section and Forum on the Construction Industry) Bar
Associations. Mr. Hedberg serves as co-chair of the Membership Subcommittee
of the Construction Litigation Committee of the American Bar Association.
He is also a member of the Connecticut Building Congress, serving
as co-chair of the 2004 and 2005 Robert J. LeFloch Memorial Golf
Outings which benefit the Habitat for Humanity of Greater New Haven.
Mr. Hedberg
co-authored Surety Bad Faith After PSE Consulting: An Implicit
Bar to Indemnification, which was published in the Fall
of 2004, Volume 14, No. 1 of Construct!, a publication of
the American Bar Association, Litigation Section, Construction Litigation
Committee. He also co-presented a seminar on Connecticuts
ethics laws in 2004.

Cases Include:
K&W Construction, LLC v. Frank Mercede and Sons, Inc., Docket
No. (X02) CV 030177908S, 2005 WL 407843 (Conn. Super. Ct. Jan.
13, 2005) Obtained summary judgment on behalf of general
contractor on subcontractors claims that general contractor
breached a settlement agreement by not executing a timely assignment
to subcontractor of all rights necessary to enable subcontractor
to sue owner for loss and by not taking all steps reasonably necessary
to preserve a pass-through of subcontractors
claims under the general contract.
PSE Consulting, Inc. v. Frank Mercede and Sons, Inc., et al, 267
Conn. 279, 838 A.2d 135 (2004) Obtained
jury verdict in favor of general contractor finding that surety
was not entitled to collect money it had paid a subcontractor
for a claim allegedly covered by surety bond because surety had
breached obligation of good faith and fair dealing implied in
general agreement of indemnity. The Connecticut Supreme Court
affirmed the decision on appeal.
Successfully
defended breach of contract claims brought by subcontractors against
general contractor arising from construction of continuing care
retirement community in Stamford, Connecticut, resulting in settlement
of certain claims at less than 5 percent of total amount.
Represented
developer in litigation of multi-million dollar claims and numerous
lien foreclosure actions in connection with construction of continuing
care retirement facility in Redding, Connecticut.
Represented
contractor in negotiation, settlement and litigation of claims
arising from construction and renovation of numerous municipal
projects involving schools, hospital, library, administrative
offices and recreational facilities.
Represented
homeowners in litigation of multi-million dollar claims and numerous
mechanics liens in connection with extensive renovations
and additions to residence in Darien, Connecticut.
